Ship Mortgage

Under Panamanian law, the information that must be included in the deed of mortgage is the following:

  • Name and Domicile of the Mortgagees and Mortgagors
  • Particulars of the Vessels;
  • The Agreements and Obligations Secured with the Mortgage;
  • Repayment Schedules;
  • Interests;
  • Interests Periods;
  • Power of Attorney

The complete mortgage duly executed, authenticated and legalized by apostille or/and by a Panamanian Consulate must be received the original in Panama in order to be filed in a Mortgage Deed at the Public Registry of Panama.
If the mortgage is preliminary registered through a Panamanian Consulate, the Public Registry Office gives a period of six (6) months to definitive register the Mortgage at the Public Registry Office. This period of time will be enough to receive the original of Mortgage translated to Spanish and filed the complete Deed of Mortgage.
